Welcome to Gritjam, a service provided by Gritjam Kreativ Musicolabs . This terms of use defines the relationship between us and all the users, including both registered and unregistered users and take effect when you use our Service. Please take a careful look at this Terms of Use, as well as our Privacy Policy, Cookies Policy, and Community Guidelines because it can have a crucial effect on your legal rights.

General

By using and accessing our Service, you understand and agree to this Terms of Use. If you do not agree, you should not use our Service.

Definitions

  1. ‘Site’ refers to http://gritjam.com and http://m.gritjam.com, the websites of Gritjam.
  2. ‘Service’ refers to all services provided by Gritjam through Gritjam  site(gritjam.com, m.gritjam.com), desktop and mobile application program(Apps), and all other players, widgets, tools, data, software, API(API may be subject to a separate Terms of Use).
  3. ‘Content’ refers to any and all audio, text, photos, pictures, graphics, and other content, music, video, product, data or information that you upload, store, transmit, submit, exchange, make available, or sell to or via Gritjam Service.
  4. ‘Storage’ refers to both the free 150mb of storage space provided by Gritjam, and the extra storage space you can purchase on Gritjam.

Changes to Terms of Use

We may modify or update this Term of Use from time to time. We reserve the right to change it without notice.. It remains your responsibility to check for revisions of this Terms of Use periodically. Your continued use of our Service after the revision will constitute your acceptance of the revised Terms of Use.

Registration and account security

Your real information is needed upon registration. In regards to registering and maintaining security, you need to comply with the following.

  1. You must provide real personal information to us, and you can not create an account for anyone but yourself without permission. Thus, you may not make more than one personal account.If we disable your account, you cannot create another account without our permission.
  2. You must be at least 13 years old to use the service
  3. You must keep your account information up-to-date.
  4. You are responsible for keeping your account and password secret and secure.
  5. You may not transfer your account (including any page or application you administer) without our written permission.
  6. If you select a username or URL account for your account or page, we reserve the right to delete or reclaim the username or URL account if we deem appropriate (for example, if a trademark owner complains about a username that does not closely relate to a user’s actual name).

Protecting other people’s rights

Gritjam respects the rights of all users, and all users should respect the rights of each other.

  1. It is prohibited to post any content or take any action on Gritjam that infringes or violates someone else’s rights or otherwise violates the law.
  2. If we believe that any content or information you post on Gritjam violates this Terms of Use, it may be removed by Gritjam
  3. If Gritjam removes Your Content for infringing someone else’s intellectual property, and you believe that this is a mistake, we will provide you with an opportunity to appeal.
  4. Your account would be disabled if you repeatedly infringe other people’s intellectual property.
  5. You may not use our copyrights or trademarks (including Gritjam, Gritjam logo and each of Gritjam typographic logo, etc.), or any confusingly similar marks, except as expressly permitted by our prior written permission.
  6. When you are collecting information from users, you need to: obtain their consent, make it clear that you (and not Gritjam) are the one that is collecting their information, and post a privacy policy explaining what information you are collecting and how you are willing to use it.
  7. You may not post anyone’s private identification documents or sensitive material information on Gritjam.

Safety

We also need your commitments to keep Gritjam safe. We do our best, but alone, we cannot guarantee it :

  1. You may not post spam or any unauthorized commercial communications.
  2. You may not collect other users’ personal information.
  3. You may not access Gritjam using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
  4. You may not engage in illegal multi-level marketing, such as the pyramid scheme, on Gritjam.
  5. You may not upload viruses or other malicious codes.
  6. You may not request login information or access an account belonging to someone else.
  7. You may not bully, intimidate, or harass other users.
  8. You may not post Content that is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
  9. You may not develop or operate a third-party application containing alcohol-related, dating or other mature Content(including advertisements) without the appropriate age-based restrictions.
  10. You shall follow our Promotions Guidelines and all applicable laws if you publish or offer any event on Gritjam.
  11. You may not use Gritjam to do anything illegal, misleading, malicious, or discriminatory.
  12. You may not do anything that could disable, overburden, or impair the proper working or appearance of Gritjam, such as a denial of service attack or interference with page rendering or other Gritjam functionality.
  13. You may not facilitate or encourage any violations of this Terms of Use.

Storage

Gritjam provides 150mb of storage space (hereinafter ‘Storage’) to all users to upload and store your music files. However, the extensions of the music files you can upload on the Storage are limited to mp3, wav, wmv, and flac. If you consider the Storage is insufficient, you may upgrade your Storage at any time. For detailed information about Storage upgrade, please refer to our Studio Use (link at Help).

 

What you can do with Gritjam

  1. Create your own new song and / or upload your own backtrack’ song. It can be your original creation or cover version.
  2. Remake a song to your own version.
  3. Participate in an event created by Gritjam or other users.
  4. Collaborate to create a song with other users.
  5. Remix a song with your own style.
  6. Publish your original songs to our publishing platform.
  7. Enjoying the demos and create playlist.

Your content

By uploading Content to or through Gritjam, you acknowledge that you, and not Gritjam, generate,, own, and control the content.  We will not claim any ownership rights regarding your Content. You acknowledge and agree that your Content remains your sole responsibility. You must not upload, store, , send, distribute, transmit, display, perform, make available any contents to which you do not hold the necessary rights. In particular, any unauthorized use of copyright protected material within your Content may constitute an infringement of rights of copyright owner and is strictly prohibited. Any such infringements may result in termination of your access to our Service as described in the Termination section below, and may also result in civil litigation or criminal prosecution by or on behalf of the relevant rights holder.

If you set your content as “public”, you acknowledge and agree to permit other users to use your content; combine and mix, with any other contents without any changes.

Changes to our Service, accounts, and pricing

We reserve the right at any time and for any reason to suspend, discontinue, terminate, or cease providing access to our Service or any part thereof, temporarily or permanently, and whether in its entirety or with respect to individual territories only. In the case of any temporary or permanent suspension, discontinuation, termination, or cessation of access, we shall use reasonable means to notify the registered users of such decision in advance. We may change the features of our Service, may withdraw or introduce new features or products, and may change the prices charged for Storage from time to time. In the event of any change in the price or features of Storage you have subscribed to, such change(s) will be communicated to you through the email to the then current email address that we have for your account, at least 4 weeks in advance, and will only take effect with respect to any subsequent renewal of your subscription.

Payments

By doing a payment on gritjam, you agree to our Payment Policy.

Termination

If you create risk or possible legal issues for us and / or breach this term of use, we may stop providing all or part of our Service to you.

Transfer of rights

  1. Without our consent, your rights and duties under this Terms of Use may not be transferred to another person.
  2. We may, at our own discretion, transfer all or part of our rights and duties under this Terms of Use related to merger and acquisition, disposal of assets, or other effects without prior notice.

Disputes

  1. You will resolve any claim, cause of action or dispute(claim) you have with us arising out of or relating to this Terms of use or Gritjam exclusively in the Republic of Indonesia you agree to submit to the personal jurisdiction of the court for the purpose of litigating all such claims. The laws of the Indonesia will govern this Terms of Use, as well as any claim that might arise between you and us, without regard to conflict of law provisions.
  2. If anyone brings a claim against us related to your actions, content or information on our Service, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind(including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users’ actions on our Service and are not responsible for the contents or information users transmit or share on our Service. We are not responsible for any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content or information you may encounter on our Service. We are not responsible for the conduct, whether online or offline, of any user of our Service.

  5. E. Sex/Nudity - Ads may not contain adult content, including nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative.
  6. F. Shock Value - Ads may not be shocking, sensational or disrespectful, or portray excessive violence.

Advertisers must ensure that their ads comply with all applicable laws, regulations and guidelines. All claims in ads must be adequately substantiated, and must.not offend users. Ads must not violate the rights of any third parties and contain or promote illegal products or services.

1. Dating

Ads for adult friend finders or dating sites with a sexual emphasis are not permitted.

2. Adult Products

Ads may not promote the sale or use of adult products or services, including but not limited to videos, publications, live shows, or sexual enhancement products. Ads for family planning and contraception are allowed provided they follow the appropriate requirements.

3. Alcohol

Where a user's age or country cannot be determined, the ad must not be displayed to the user. Where permissible, ads that promote or reference alcohol must apply age and country targeting criteria consistent with applicable local laws.

4. Drugs and Tobacco

Ads may not promote illegal or recreational drugs, tobacco products, or drug or tobacco paraphernalia.

5. Pharmaceuticals and Supplements

  • Ads for non-certified pharmaceuticals or related sites are prohibited except that Ads for certified pharmaceuticals may be restrictively permitted with extra discussion from with us.
  • Ads that promote dietary and herbal supplements are generally permitted, provided they do not promote products deemed unsafe or questionable by us in our sole discretion.

6. Weapons and Explosives

Ads may not promote the sale or use of weapons, ammunition, or explosives.

7. Gambling, Lotteries

Ads that promote or facilitate online gambling, games of skill or lotteries, including online casino, sports books, bingo, or poker, are only allowed in specific countries with prior authorization from us.

8. Multi-level Marketing Schemes and Scams

Ads may not be promoted that are deemed by us in our sole discretion to be unacceptable or contrary to any applicable law, including but not limited to multi-level marketing schemes, or advertisements for scams.

9. Software

Ads may not contain or link directly or indirectly to a link that contains spyware/malware downloads or any software that violate user’s safety.

10. Paid Services

Ads for subscription services, or that promote products or services that include automatic renewal and free-to-pay conversion billing products are subject to the following requirements:

  • Ad text must clearly and conspicuously disclose the recurring billing component (price, billing interval and etc.).
  • Ads must include an unchecked opt-in checkbox;
  • Ads must include language informing users how to cancel their payment or membership
  • Each of the foregoing must be located in a prominent place, as determined in our sole discretion, and should be easy to find, read, and understand.
